Terms of Service

1. Acceptance of Terms

By accessing or using TechJobsPortal ("the Platform"), operated by The Consulting Solutions ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

2. Eligibility

You must be at least 16 years old and have the legal capacity to enter into a binding agreement to use the Platform. If you are using the Platform on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

3. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete registration information.
• Keep your account information up to date.
• Notify us immediately of any unauthorized access or security breach.
• Not share your account credentials with third parties.

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

4. Platform Services

TechJobsPortal provides a marketplace connecting IT professionals (candidates), companies seeking to hire, and freelance recruiters. Our services include:

• Vacancy posting and management for companies.
• Candidate profile creation and job applications.
• Recruiter access to vacancies and candidate submission tools.
• AI-powered matching and recommendation features.
• Communication tools between parties.

We act as an intermediary and do not guarantee employment outcomes. The hiring decision rests solely with the company.

5. User Roles and Obligations

5.1 Companies

Companies agree to post accurate vacancy information, respond to candidates in a timely manner, and comply with applicable employment laws. Companies must not post discriminatory, misleading, or fraudulent vacancy listings.

5.2 Candidates

Candidates agree to provide accurate professional information, including work history, skills, and qualifications. Candidates must not submit false or misleading information in their profiles or applications.

5.3 Recruiters

Recruiters agree to submit only qualified, consenting candidates. Recruiters must respect the 5-CV submission limit per vacancy and must not submit candidates without their explicit consent.

6. Fees and Payments

Certain features of the Platform are available for free. Premium features require a paid subscription (Pro or Enterprise plan). Additionally, a success fee may apply when a hire is made through the Platform.

• Subscription fees are billed monthly and are non-refundable unless otherwise stated.
• Success fees are agreed upon before the hiring process and invoiced upon placement confirmation.
• Recruiter commissions are paid within 30 days of confirmed placement.
• All prices are in EUR and exclusive of applicable taxes unless stated otherwise.

We reserve the right to modify pricing with 30 days' notice to affected users.

7. Content and Intellectual Property

You retain ownership of the content you submit to the Platform (profiles, CVs, vacancy descriptions). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content for the purpose of providing our services.

The Platform, including its design, code, logos, and trademarks, is owned by The Consulting Solutions and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Platform without our prior written consent.

8. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Post false, misleading, or discriminatory content.
• Scrape, crawl, or use automated tools to extract data from the Platform.
• Attempt to gain unauthorized access to other user accounts or Platform systems.
• Interfere with or disrupt the Platform's infrastructure or security features.
• Circumvent any access restrictions, submission limits, or fee structures.
• Use the Platform to send unsolicited communications (spam).

9. Limitation of Liability

To the maximum extent permitted by law, TechJobsPortal and The Consulting Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from these Terms or your use of the Platform shall not exceed the amounts paid by you to us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure. We do not guarantee employment outcomes, candidate quality, or the accuracy of information provided by other users.

11. Indemnification

You agree to indemnify and hold harmless TechJobsPortal, The Consulting Solutions, and their officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Platform, your content, or your violation of these Terms.

12. Termination

You may close your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or if required by law. Upon termination, your right to use the Platform ceases immediately. Provisions regarding intellectual property, limitation of liability, and indemnification survive termination.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Spain, without prejudice to your rights as a consumer under mandatory applicable law.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the Platform or by email. Continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.
